What is the role played by intention – of the author of a text, of
the legislator, of a speaker or an agent – in the process of
interpretation – of a text, ra role, a discourse or a behaviour? The
analyses carried ont in the papers published in this volume aim at showing
the complex character of the concept of intention in the legal domain.
Thanks to philosophical investigation on intentionality, these articles
point out the intention which becomes relevant in interpreting is not the
intention of a single subject, but rather that of several subjects, who
come into contact trough the application of the law. This topic, being
concerned with several important debates which has yet to be resolved in
different fields, is a nexus of the inquiry about the constraints on
interpretation.
Welche Rolle spielt die Intention – des Autors, des Gesetzgebers, des
Sprechers oder des handelnden Subjekts – im Auslegungsprozeß eines
Textes, einer Norm, eines Diskurses oder einer Handlung? Die hier
vorgelegten Beiträge zeigen den komplexen Charakter des Intentionsbegriffs
im juristischen Bereich. Dank einer philosophischen Reflexion über den
Begriff der Intentionalität erweisen sie im besonderen, daß die für die
Interpretation ausschlaggebende Intention im juristischen Bereich nicht
dem Einzelnen gehört, sondern einer Pluralität von Subjekten, die sich
miteinander in der Anwendungsphase in Verbindung setzen. Das Thema der
Intention steht damit in verschiedenen Disziplinen zur Debatte und wird
zum Kernpunkt der Reflexion über die Grenzen der Interpretation.
